CONSTITUTIONAL LAW OF TERRITORIAL AUTONOMIES
Oral exam. There is the possibility of intermediate tests. There is also the possibility of a practical test, consisting in setting the juridical-constitutional profiles of a concrete case, which can be taken either during the course, or in the final exam
The course deepens the skills concerning territorial autonomies acquired through the study of constitutional law. The goal is to be aware of the numerous and complex issues inherent in the allocation of public functions between the various levels of government in the context of the dynamics of a contemporary democracy such as Italy.
1. Historical sketch of Italian regionalism: its birth, the implementation of the ordinary Regions from the first transfer of functions to the so-called "Administrative federalism", and the constitutional reforms of the years 1999-2001; 2. Legislative autonomy: the exclusive competence of the State, the concurrent legislation, the residual legislative power of the Regiona and the so-called "legislative subsidiarity"; 3. The matters of exclusive competence, the matters of concurrent competence and those of residual competence; 4. Regulatory powers of State and Regions; 5. The path of administrative autonomy from the principle of parallelism to the principle of subsidiarity; 4. The financial autonomy; 5. The constitutional status of the smaller territorial autonomies; 6. The instruments of interinstitutional collaboration between State and territorial autonomies; 7. The special Regions; 8. The so-called “Differentiated regionalism” enshrined in the art. 116, third paragraph, of the Italian Constitution; 9. The constitutional reform of the Senate and the autonomy system: problems and perspectives.

Frontal lessons. The students will be asked to test their skills in cases of constitutional law of territorial autonomies drawn from the institutional experience of recent years, with particular attention to current institutional issues. Students will be invited to discuss such cases in the classroom, including through the use of databases of legislation, case law and practice.
