GENERAL THEORY OF LAW

At the end of the course, the student should have acquired the knowledge of the main problems related to the general theory of law, with reference in particular to the various theoretical positions inside the twentieth-century debate. Students learn to identify and use the techniques related to the interpretation of the law, identification / creation of legal gaps, solution of the antinomies
The course will be devoted to an introduction and critical analysis of the concept of law and of the concepts and problems related to it. The first part will be dedicated to the exhibition of the main legal theories discussed in the course of the twentieth century (including legal positivism, legal realism, neo-constitutionalism). The second part will focus the problems of completeness and closure of the legal system, legal gaps, validity and interpretation of the law.
