Objectives

Provide the student with an ability to research, select and identify the rules that govern the general cases of criminal law, to interpret them, to use the tools of doctrine and jurisprudence as an aid to understand the problems that the single rule (general case) it can have in its application to individual concrete cases.

Contents

The Course of Institutions of Criminal Law and Juvenile Legislation aims to provide a broad and systematic view of both the rules of the CRIMINAL system (general part), and the special part, with a particular look at the figure of the minor.

Important and fundamental elements will be dedicated to international norms, to the significant influences of the ECHR which must safeguard the citizen's protections against punitive action by the State and to the EU system, to the EU's "competences" in the criminal sector.

The commission of a crime (crime-offense), in particular by the minor, is undoubtedly a representation of a situation of particular uneasiness for the citizen, of his choices in relation to the community that surrounds him, such as to invoke multiple interventions in diversified contexts: political, social, family, community, on the negative value and on the modification of the common sensitivity of certain behaviors, on the absent or undermined understanding of the legal assets of constitutional relevance underlying and to be safeguarded.

The analysis of the juvenile penal system is a discipline characterized by a strong specialist component, called to give mediated answers and to combine the purposes and characteristics of criminal law with the protection of the development of the educational processes of the minor.
