For the study of matter requires a good knowledge of Italian constitutional history from 1861 to present, and basic notions of general theory of law and state.

Objectives

The course intends to deepen the general constitutional law topics, with particular attention to the concepts of the Constitution and of constituent power, of State and sovereignty, of political power and constitutionalism; and positive constitutional law, with specific reference to the characters of the Italian Constitution and its principles, forms of Government, to the structures and Italian State bodies, the sources of law and authorising substances. Primary purpose of this course is to initiate the student to the study of the State democratic and Republican organization.

The sovereignty and the democratic principle. Citizenship.-The Italian Constitution, the fundamental constitutional principles. Pluralistic democratic State. Inviolable rights and duties required. Social formations and status. The principle of equality.The forms of Government. Critical insights on the distinction.The sources of law and their criteria authorising officers. Sources of knowledge and sources of production. Sources Act and sources did. Primary sources and secondary sources.Legal acts. Classification criteria with regard to their nature and their effects.The Italian State and its constitutional organization. Constitutional organs and organs of constitutional significance.Parliament, Government and public administration. The President of the Republic. The Constitutional Court. The Judiciary autonomous territorial Entities property. The Regions. Characteristics of Italian regionalism and its evolution. The new title V of the Constitution. neutral powers. Independent administrative authorities.The constitutional guarantees and fundamental rights.Civil rights, political rights and social rights.
