The course, of a theoretical and practical nature, is made up of two modules, dedicated respectively to the study of the principles on criminal law and of the juvenile legislations, paying attention both on the subject of minor offender and on the victim of the same.
Module sub 1 aims to provide the student with the fundamental notions of criminal law, necessary for the training of the social operator of law. The topics of criminal law, the principle of legality with its corollaries, the notion and structure of the crime, the objective and the subjective element, the causes of justification, the circumstances of the crime, the attempt, the participation of persons in the offense, the function of the penalty, its application and the extinction of the offense and the penalty.
Module sub 2 aims to illustrate to students the peculiar characteristics of criminal proceedings before the Juvenile Court as well as disciplined in d.P.R. n. 448/1988, with particular attention to practice (practical cases will be discussed in the classroom) and to the specific institutes that convey this differentiated procedure to the lesser alleged perpetrator.
It will deal with the following topics: international and domestic sources of child law; general principles; the organs of juvenile justice; imputability and findings of the child's personality; the restrictive measures of personal freedom; the stages of the proceedings, with particular regard to the alternative ways of defining it: a decision not to proceed with the irrelevance of the case, losing the court and suspending the trial being put to the test; mediation; penalties; security measures.
The other part focuses on studying the peculiarities of the involvement of the minor as a victim of crime, paying particular attention to this following topics: the vulnerable victim; the ownership of rights in supranational sources and in domestic law; secondary victimization; the protection measures for the victim during the criminal proceedings, with particular reference to: affective and psychological assistance; assisting an expert in hearing the child; "Protected" Hearing Mode.
