Penitentiary law
Final exam will be oral, and it will consist of three questions about different topics.
The course aims to provide students with knowledge and methodological tools necessary for critical learning of the Italian penitentiary system. At the end of the course students will have acquired:
- basic knowledge regarding Italian penitentiary law;
- methodological and interpretative skills necessary for a systematic vision of the subject.
Sources of penitentiary law, with particular reference to constitutional and supranational principles.
- Prisoners' rights.
- Penitentiary treatment
- Offenders' observation and rehabilitative treatment.
- Elements of the treatment.
- Support and reward instruments.
- Disciplinary regime.
- Strict instruments (special surveillance regime and suspension of the rules of penitentiary treatment).
- Different kinds of detention.
- Alternative measures to detention.
- Restrictive and rewarding regimes of access to alternative measures and benefits.
- Structure and functions of the Sentence Supervision Tribunal and Judge.
- Supervision procedure.
- Complaint procedures.
